Copyright Policy

Peppercrest LLC ("Peppercrest," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This Copyright Policy describes how we respond to claims of copyright infringement on our services in accordance with the Digital Millennium Copyright Act ("DMCA").
1. Reporting Copyright Infringement
If you believe that content on our services infringes your copyright, please submit a DMCA takedown notice containing the following information:

Identification of the copyrighted work you claim has been infringed. If multiple works are involved, provide a representative list.

Identification of the infringing material and information reasonably sufficient to locate it on our services (such as a URL or description).

Your contact information, including your name, address, telephone number, and email address.

A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Your physical or electronic signature (or the signature of someone authorized to act on your behalf).
2. Submitting a Notice

We respond to valid DMCA notices promptly. Please provide complete information to avoid delays in processing your request.
3. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing the following:

Identification of the material that was removed and the location where it appeared before removal.

A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.

Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the Northern District of California if outside the United States), and that you will accept service of process from the person who submitted the original DMCA notice.

Your physical or electronic signature.
Send counter-notifications to the same address listed above with the subject line "DMCA Counter-Notification."
4. Process
Upon receiving a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the content (if applicable)
- Provide information about submitting a counter-notification
Upon receiving a valid counter-notification, we will:
- Forward a copy to the original complainant
- Inform them that we will restore the content in 10 business days unless we receive notice of a court action
- Restore the content after 10-14 business days if no such notice is received
5. Repeat Infringers
We maintain a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances. We determine repeat infringer status at our discretion, considering factors such as:
- Number of valid infringement notices received
- Whether notices involved the same or different works
- Whether the user filed counter-notifications that were not challenged
6. Misrepresentation
Under the DMCA, you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that content infringes your copyright or that content was removed by mistake. Please consider whether fair use, fair dealing, or a similar exception applies before submitting a notice.
